Formalising the booking implies acceptance of these terms and conditions and, where applicable, of the specific conditions shown on the activity page or during the booking process.

In the event of a conflict between these general terms and a specific condition expressly communicated before contracting a particular service, the specific condition shall prevail, provided that it complies with the applicable regulations.

1. SERVICES AND ACTIVITIES

Peña Txuri Surf Eskola offers, among other services, surf lessons and courses at different levels, private and semi-private lessons, lesson vouchers, improvement and high-performance courses, camps, group activities and equipment rental.

Before contracting, the customer may consult the main characteristics of the service: total price, duration, date or timetable where applicable, required age or level, equipment included, place of performance and any other relevant conditions. The information published on each activity page forms part of the pre-contractual information.

3. BOOKINGS, AVAILABILITY AND FORMATION OF THE CONTRACT

Bookings may be made through the website or directly with Peña Txuri Surf Eskola through the enabled channels. Places are limited and subject to availability.
Bookings are recommended to be made at least 24 hours in advance.

3.1. Bookings made less than 24 hours in advance

Where the system allows a booking to be requested or processed within the 24 hours prior to the start of the activity, that booking may require organisational validation by the school due to the actual availability of places, instructors, equipment and, where applicable, transport.

If the booking cannot be accommodated, Peña Txuri Surf Eskola will contact the customer as soon as possible to offer an alternative time or date. If no alternative is suitable, 100% of the amount paid will be refunded.

Whenever technically possible, online bookings made less than 24 hours in advance will be configured as availability enquiries, or the customer will be expressly informed when the booking becomes confirmed.

3.2. Acceptance of the terms

Before completing an online booking, the customer must have access to these terms and expressly accept the applicable contracting and cancellation conditions. Consent to commercial communications, where requested, will be separate and voluntary.

4. PRICES

The applicable prices will be those published on the website or expressly communicated to the customer before the contract is formalised. The prices shown will include all legally applicable taxes.

Before confirming a booking, the customer will be able to know the total price of the service and any mandatory additional charge that may apply. No mandatory supplements will be applied unless they have been disclosed in advance.

5. PAYMENT METHODS

Depending on the service contracted, payment may be made online through the website, by bank transfer, bank card, cash at the premises or through a payment platform/link provided by the school. The specific payment conditions will be indicated during the contracting process.

Where an online booking entails an obligation to pay, the final step of the process must clearly and unambiguously identify that obligation before the customer confirms the order.

6. SURF LESSONS AND COURSES

6.1. Booking and payment

As a general rule, lessons and courses are booked by paying 20% of the total amount in advance. The remaining 80% must be paid before the activity begins using the available payment methods.

6.2. Changes and cancellations by the customer

The customer may request a change of date and/or time at least 24 hours before the start of the activity. The change will be subject to availability and will not incur a penalty.

If a cancellation or request for a change is communicated less than 24 hours in advance, the 20% deposit paid to formalise the booking will not be refundable.

Where inability to attend is due to a duly documented injury or illness, section 10 will apply.

6.3. No-show

If the participant does not attend on the booked day and time without having changed or cancelled within the established period, the activity will be considered provided and there will be no entitlement to a refund or change of date.

6.4. Private and semi-private lessons

Private and semi-private lessons are governed by the same change, cancellation and no-show policy established for surf lessons, unless a different specific condition has been communicated in advance in the particular offer.

7. LESSON VOUCHERS

5- and 10-lesson vouchers are valid for one year from the date of purchase and are personal and non-transferable.

Purchasing a voucher does not guarantee a place on a particular day or at a particular time. Each lesson must be booked in advance and is subject to availability.

A lesson booked using a voucher may be cancelled or changed at least 24 hours in advance without being deducted from the voucher. The new date is subject to availability. If it is cancelled or a change is requested less than 24 hours in advance, or if the participant does not attend, the lesson will be considered used and deducted from the voucher.

Where a voucher is purchased at a distance without a specific date or period of performance, the right of withdrawal will apply where legally applicable. If the customer expressly requests that performance begin during that period, the consequences provided by law for services already commenced will apply.

8. GROUP BOOKINGS

A deposit of 50% of the total amount is required to confirm a group booking for 6 or more participants. The booking will be made for a specified number of participants, which will be used to arrange places, instructors and equipment.

8.1. Groups of 6 to 17 participants

The final number of participants may be changed up to 24 hours before the activity begins. If a reduction is communicated less than 24 hours in advance, the amount corresponding to the previously confirmed number of participants must be paid.

8.2. Groups of 18 or more participants

The final number of participants must be communicated at least 72 hours in advance. After that deadline, any reduction in attendance will not reduce the price and the amount corresponding to the previously confirmed number of participants must be paid.

8.3. Changes and no-show

If a reduction is communicated within the applicable deadline, the amount will be recalculated according to the final number of participants and the rate applicable to that new number. Any increase is subject to availability and must be confirmed by Peña Txuri Surf Eskola.

If the group does not attend, the 50% deposit paid will not be refundable.

9. SURF CAMPS

9.1. Booking and payment

Camps must be paid in full at the time of booking, unless another payment method is expressly indicated.

9.2. Cancellation by the customer

More than 30 calendar days before the start: 90% of the amount paid will be refunded; 10% will be retained as administration costs.

Between 30 and 15 calendar days before the start: 50% of the amount paid will be refunded.

Less than 15 calendar days before the start: no refund will be made.

No-show: no refund will be made.

9.3. Exception for illness or injury

If the participant is unable to take part due to illness or injury and provides a medical certificate, 90% of the amount paid will be refunded, regardless of when the cancellation occurs; 10% will be retained as administration costs.

9.4. Leaving the camp

Voluntarily leaving the camp once it has started will not, as a general rule, entitle the participant to a full or partial refund for unused days. Cases of duly documented injury or illness will be governed by the following section.

10. INJURY OR ILLNESS FOR LESSONS AND VOUCHERS

If an injury or illness prevents attendance at a lesson, the school must be informed and a medical certificate provided. For individual lessons, a change to another available date may be offered without applying the usual cancellation penalty. For vouchers, the lesson will not be deducted where the inability to attend is duly documented.

Where a duly documented injury or illness prevents a participant from continuing a course that has already started, the school will consider allowing the unused part to be taken on another available date or another solution appropriate to the service and circumstances.

Refunds will, whenever possible, be made using the same payment method used for the booking.

11. SEA CONDITIONS, WEATHER AND CHANGES

Surfing takes place in a changing natural environment and is affected by waves, wind, tides, currents, weather, beach conditions and other circumstances that may affect the conduct and safety of the activity.

Participant safety will take priority over the timetable, beach or plan initially scheduled. For safety reasons or to ensure suitable conditions, Peña Txuri Surf Eskola may change the time, beach or area where the activity takes place, meeting point or session plan.

Such changes will not in themselves constitute cancellation of the service where the activity can be carried out in suitable and safe conditions.

If it is ultimately not possible to carry out the activity safely and no suitable alternative can be offered, the customer may choose between changing the date at no additional cost or receiving a 100% refund of the amount paid for the service not provided.

12. CANCELLATION, MODIFICATION OR POSTPONEMENT BY THE SCHOOL

Peña Txuri Surf Eskola may cancel, modify or postpone an activity where unforeseen circumstances prevent it from being carried out properly or safely, including adverse sea or weather conditions, official alerts, safety issues, force majeure or other unforeseen circumstances.

Where the activity is definitively cancelled and is not provided, the customer will be offered a change to another available date at no additional cost or a 100% refund of the amount corresponding to the service not provided.

13. RIGHT OF WITHDRAWAL

As a general rule, consumer legislation recognises a 14-calendar-day right of withdrawal for certain distance contracts.

However, where legally provided, this right does not apply to services related to leisure activities where the contract provides for a specific date or period of performance.

Accordingly, lessons, courses, camps and other activities contracted for a specific date or period will be governed by their cancellation policy rather than the general 14-day right of withdrawal where this exception applies.

Vouchers or other services purchased without a specific date or period of performance will be governed by the withdrawal rules that are legally applicable.

14. MINORS

Bookings for participants who are minors must be made or authorised by their father, mother, legal guardian or duly authorised person. The responsible person must provide the information necessary to ensure appropriate and safe participation.

Each activity may establish minimum ages, ratios, levels and specific requirements, which will be indicated in the information corresponding to the service.

15. SAFETY AND PARTICIPATION REQUIREMENTS

Participants must follow the instructions of the technical staff at all times and comply with the safety rules established by Peña Txuri Surf Eskola.

The participant or, in the case of minors, their legal guardians must inform the school before the start of any circumstance relevant to carrying out the activity safely, including injuries, allergies, medication, support needs or other circumstances that may require adaptation.

The existence of a disability or specific need will not in itself prevent participation. The school will assess the conditions or adaptations necessary for the activity to be carried out appropriately and safely.

The school may prevent a participant from starting or may interrupt participation where there is an objective risk to the participant, other users or staff, particularly where safety instructions are not followed.

16. RISKS INHERENT IN SURFING

The participant acknowledges that surfing is a sporting activity carried out in a natural environment and involves inherent risks related, among other things, to waves, currents, seabed conditions, weather conditions, equipment used and the presence of other users.

Participation is voluntary and entails a commitment to follow the instructions provided by the instructors.

Acceptance of the risks inherent in the activity does not exclude or limit Peña Txuri Surf Eskola's legal liability where there is negligence, failure to comply with safety obligations or any other legally enforceable liability.

17. INSURANCE AND ACTION IN THE EVENT OF AN ACCIDENT

Peña Txuri Surf Eskola holds the insurance required for the activities it organises, including Public Liability Insurance and Accident Insurance, within the coverage, limits, exclusions and conditions established in the policies in force.

17.1. Reporting and assistance

Any accident occurring during an activity must be reported immediately to the responsible instructor and school staff so that the corresponding report can be opened and processed correctly.

The participant must follow the instructions provided by the school and the insurance company regarding medical centres, professionals and procedures established in the policy. Assistance received outside the centres or procedures established by the insurer may affect coverage or reimbursement of expenses in accordance with the terms of the policy.

In situations requiring urgent medical attention, the necessary care will always be prioritised.

The specific conditions of coverage, reporting deadlines, approved centres, limits and exclusions will be those established in the policies in force. In the event of any discrepancy, the policy and applicable regulations will prevail.

18. EQUIPMENT RENTAL

Equipment rental is provided in person at the school, does not accept advance bookings unless expressly indicated otherwise, and is subject to availability at the time of arrival.

18.1. Conditions of use

The customer must use the equipment appropriately, following the school's instructions, and return it within the contracted timetable and period. The equipment may not be kept outside the rental period or overnight unless expressly authorised.

Rates, opening hours, available equipment and maximum rental duration will be those published at the school and/or on the website at any given time, with the final price and taxes included.

18.2. Damage, loss and liability

The customer must report any damage, loss or incident involving the equipment. Liability for damage or loss will be determined according to the specific circumstances, the use made of the equipment and the applicable regulations. The customer will not be charged for damage resulting from normal wear and tear or defects not attributable to improper use.

19. BOOKING CONFIRMATION AND CHANGES

Once an online booking has been formalised, the customer will receive confirmation by email or another durable medium. The confirmation will identify, as applicable, the contracted service, date and time, number of participants, total price, amount paid, outstanding amount and essential information for participating in the activity, as well as the applicable terms or stable access to them.

The customer must check the details of the booking and notify the school of any error as soon as possible. Customers cannot modify bookings directly in the system; any request for a change must be made by contacting Peña Txuri Surf Eskola and is subject to the applicable conditions and deadlines.

20. COMPLAINTS AND CONSUMER SERVICE

Peña Txuri Surf Eskola has official complaint forms available to consumers and users at its premises, in accordance with the regulations in force in the Basque Country.

The availability of complaint forms will be announced by means of the corresponding official bilingual notice, displayed visibly and legibly at the establishment, bearing the wording: «Nahi duenak eskuragarri ditu erreklamazio-orriak / Existen hojas de reclamaciones a disposición de quienes las soliciten» (complaint forms are available on request).

Complaint forms will be provided free of charge and immediately upon request, at the same establishment or at the location identified for customer information or service.

For any query or incident relating to a booking or service, the customer may contact the school on 600 300 244 or at ptxsurfeskola@gmail.com.

21. DATA PROTECTION AND COMMERCIAL COMMUNICATIONS

Personal data provided during contracting will be processed in accordance with the applicable data protection legislation and the Privacy Policy published on the website.

Where necessary to provide the activity appropriately and safely, additional participant data may be requested, particularly in the case of minors, in accordance with the legal basis and conditions indicated in the Privacy Policy.

Consent to commercial communications will be separate from acceptance of these terms.

Where consent is requested to receive news or promotions, the option must not be pre-ticked and the customer may withdraw consent by the means indicated in the Privacy Policy.

22. AMENDMENT OF THE TERMS

Peña Txuri Surf Eskola may update these terms to adapt them to legal, organisational or service changes. New terms will apply to bookings made after their publication.

Bookings formalised previously will continue to be governed by the terms accepted at the time of contracting, unless a mandatory rule applies.

23. APPLICABLE LAW AND CONSUMER RIGHTS

These terms will be governed by Spanish law and by the applicable legislation protecting consumers and users.

Nothing in these terms is intended to exclude or limit rights that mandatory legislation grants to consumers and users.

PEÑA TXURI SURF ESKOLA S.L.Last updated: 4 October 2026 These terms and conditions govern the booking, contracting and participation in the services and activities offered by PEÑA TXURI SURF ESKOLA S.L., both through its website and by contracting directly with the school.
